Welfare and Institutions Code – Relating to Foster Children

An act to amend Sections 48853.5, 48911, and 48915.5 of, and to add Section 48918.1 to, the Education Code, and to amend Sections 317 and 16010 of the Welfare and Institutions Code, relating to foster children.

Summary

AB 1909 ensures that school districts provide notification to a county child welfare designee and the court-appointed attorney for the foster youth when a foster youth is pending expulsion or subject to a manifestation determination Individualized Education Program.

Our Position: Support

The Individuals with Disabilities Education Act (IDEA) makes a fundamental assumption: that every student has someone going to bat for them, representing them in IEP meetings, and advocating for them even when they make mistakes. Youth in care often have no one to do this—and certainly will not if those responsible for such advocacy are not alerted to the need. This bill is an important piece in ensuring that this does not occur.
