Ronnie Maurice Stewart, et al. v. Alex M. Azar II, et al. - Disability Rights Education & Defense Fund
January 30, 2019 DREDF, along with AARP, Justice in Aging, and the National Academy of Elder Law Attorneys, filed an amicus brief in the D.C. District Court supporting the National Health Law Program’s complaint against the Centers for Medicare and Medicaid Services (CMS) for reapproving Kentucky’s 1115 Medicaid Waiver Application. Kentucky’s latest 1115 waiver continues to propose restrictive work requirements, premium payments, and additional administrative burdens, as well as eliminate non-medical transportation as a Medicaid benefit, for many Medicaid beneficiaries in the state. CMS’s approval of Kentucky’s first 1115 Waiver application was struck down by the D.C. court for failing to be in accordance with the fundamental purposes of the Medicaid Act.
