On the eve of the ADA’s 22nd anniversary, DREDF, with Disability Rights Advocates (DRA) and Lewis Feinberg Lee Renaker & Jackson, has filed Center for Independent Living, et al., v. Wal-Mart Stores, Inc. that calls for the retail giant to ensure equal access to shoppers with mobility disabilities. The primary goal of the case is to make Wal-Mart’s point–of–sale terminals accessible to people who use wheelchairs and scooters.

Complaint That CMS Doesn’t Provide Alternate Formats

DREDF made an administrative complaint to the Office of Civil Rights of the U.S. Department of Health and Human Services on grounds that the Centers for Medicaid and Medicare (“CMS”) continues to fail to provide alternate formats to individuals who are blind or visually impaired.

While we were disappointed that accessibility standards were not included in HHS’s July 2010 final rule establishing stage 1 “meaningful use,” we are encouraged by the Department’s inclusion of disability specific questions in its latest request for comments. We strongly urge the Department to adopt explicit accessible information technology standards within stages 2 and 3 MU to both improve health outcomes for all patients with sensory, cognitive or mobility limitations, and to ensure that a technological system that has been mandated to reduce health disparities does not in itself act to replicate and deepen the disparities experienced by people with disabilities.
