Health and Safety Code – Relating to Redevelopment

An act to amend Sections 33020 and 33021 of, and to add and repeal Section 33137 of, the Health and Safety Code, relating to redevelopment.

Summary

AB 2043 would add an order granting or denying class action certification, allowing appeal from the order at the discretion of the court of appeal. The bill would specify various factors the court would be required to consider in determining whether to allow the appeal.

Our Position: Oppose

AB 2043 overturns decades of precedent and severely undermines class action cases in California. It would dramatically curtail rather than encourage the use of class actions, provide a procedural windfall to defendants, and clog the already overburdened judicial system with piecemeal appeals of certification decisions.
