Creates nationwide protections for children from dangerous physical restraint and seclusion. Ensures that restraint is used only in emergencies posing an imminent threat of physical danger, and that school districts promptly notify parents if such restraint occurs. If less restrictive and dangerous measures like de-escalation, conflict management, and positive behavioral supports will prevent the threat, the bills will require that they be used. They also require that school staff is properly trained in such evidence-based methods to minimize the use of restraint and seclusion.

S.2020 was read twice and referred to the Committee on Health, Education, Labor, and Pensions. H.R. 1381 was referred to the Subcommittee on Early Childhood, Elementary, and Secondary Education.
Our Position: Support
For over a decade, the dangers from restraint and seclusion have been well known and documented. Reports and studies have shown that students and staff are safer when positive interventions and supports, rather than restraint and seclusion, are used in schools. With appropriate positive behavioral supports, restraint and seclusion are used less and worker’s compensation costs go down. It is time to protect school children with national legislation, and establish national minimum standards.
